Saheeh Al-Jami ‘As-Saghir Hadith No. 290

 «إذا اختلف البيعان وليس بينهما بينة والمبيع قائم بعينه فالقول ما قال البائع أو يتركان البيع» .
(صحيح) … [هـ] عن ابن مسعود. الإرواء 1223)

It is reported that the Prophet (peace and blessings of Allaah be upon him) said:

 ‘If two parties to a transaction differ, and they have no proof, and the sale item remains (unredeemed), then what the seller says is valid. Or they may cancel the transaction.” 

This hadith was narrated by Ibn Majah 2186 from the words of Ibn Mas’ud. 

Sheikh al-Albani called the hadith authentic. See Sahih al-jami ‘as-saghir 290, Irvaul-galil 1323.


Benefits from this hadith

It is obligatory for online ecommerce stores to have return policy for their goods without levying a penalty on the buyer, if the buyer wants to annul the transaction because of false perception of the item as seen through pictures on the online store and in reality it differs or whatever case it may be and if he has not made use of the goods.
