«إذا اختلف البيعان وليس بينهما بينة فهو ما يقول رب السلعة أو يتتاركان» .

It is reported that the Prophet (peace and blessings of Allaah be upon him) said:
“If the buyer and the seller disagree, and none of them have evidence (in favor of their veracity), then the final verdit is for the owner of the goods, or they may annul the transaction.”
This hadith was narrated by Abu Dawood 3511, al-Nasai 7/302, al-Hakim 2/45 and al-Bayhaqi 5/332 from the words of Ibn Mas’ud.
Sheikh al-Albani called the hadith authentic. See Sahih al-jami ‘as-saghir 289, Irvaul-galil 1322, as-Silsilya al-sahiha 798.
