It is reported that the Messenger of Allah (peace and blessings of Allaah be upon him) said:
“If two Muslims confront each other with swords, and one kills the other, they will both be in Hell.” It was said: “O Messenger of Allah, (we understand about) the killer, but what about the one who is killed?” He said: “After all, he too wanted to kill his companion.”
This hadith was narrated by Ahmad 5/43, al-Bukhari 31, Muslim 2888, Abu Dawud 4268, al-Nasai 7/125 from the words of Abu Bakr; Ibn Majah 3964 from the words of Abu Musa.
Sheikh al-Albani called the hadith authentic. See Saheeh al-jami ‘as-saghir 387.

Narrated Al-Ahnaf bin Qais:
While I was going to help this man (‘Ali Ibn Abi Talib), Abu Bakra met me and asked, “Where are you going?” I replied, “I am going to help that person.” He said, “Go back for I have heard Allah’s Apostle saying, ‘When two Muslims fight (meet) each other with their swords, both the murderer as well as the murdered will go to the Hell-fire.’ I said, ‘O Allah’s Apostle! It is all right for the murderer but what about the murdered one?’ Allah’s Apostle replied, “He surely had the intention to kill his companion.”
