It is reported that the Messenger of Allah (peace and blessings of Allaah be upon him) said:
“If there were signs that the child was born alive [1], then he is treated as an heir.”
This hadith is in Abu Dawud 2920 and al-Bayhakyi 6/257 from the words of Abu Hurayrah.
Sheikh al-Albani called the hadith authentic. See Sahih al-jami ‘as-saghir 328, al-Silsilah al-sahiha 153.
